A family has filed a
lawsuit against an elementary school teacher and the school district itself after they say their child was physically abused while at school. According to the Austin-American Statesman, teacher Jancie Day was employed by Oak Springs Elementary School in 2008 when she allegedly stuffed a towel down the throat of a five-year-old girl. The incident took place when the girl was not given permission to go to the bathroom and wet herself in the classroom. The teacher than became angry and exerted inappropriate physical force.
It seems that Day no longer works for the school, though it is unclear why she left or whether she was asked to leave because of the
child abuse incident. The Austin school district responded to the
Texas child abuse lawsuit by denying all allegations, although they also said that they took the allegations seriously when they arose two years ago and that they took the appropriate actions to remedy the situation at that time.
The girl’s parents say that their daughter suffered
mental anguish and emotional distress.
