The Rasansky Law Firm | Avoid Daycare Abuse

Abusive situations can unwittingly be entered into by anyone. The stakes are never higher when you’re dealing with your children. Daycare abuse is more common than most people think, though the real cases are sometimes confused with cases of mass hysteria that have gripped the nation at various times. In the real cases, the signs are oftentimes subtle and the damage not entirely obvious to someone not looking for it. You can make decisions in advance, however, that can help you to avoid your child becoming a victim of an abusive facility.

Everyone knows that daycare facilities need to be licensed. The requirements may vary from place to place, but an unlicensed facility is obviously more than an unacceptable risk: it’s illegal. Being licensed is not enough, however, to ensure a good facility. Make sure the staff and, especially, the childcare workers actually seem to love children. If the children they’re around seem to love them back, that’s a good sign. A childcare facility should always have a positive, fun vibe to it. If something just seems wrong, don’t risk it and look elsewhere for your childcare needs.

You should ask some tough questions of any childcare facility before you engage their services. In addition to being tough, however, they should be broad. Ask about the staff that doesn’t work with the children. Have they all had background checks run? How many people at the facility know basic CPR and first aid? Has the facility received any safety violations or citations? If someone bristles at these questions, that’s not right. A good facility will be proud to tell you that they haven’t had violations, that they background check everyone and that their staff is trained and equipped to deal with any realistic emergencies that may arise.

If you find a good facility, daycare negligence should not be a problem. Many of these facilities are top-notch and run by people who love children enough that they want to take care of other people’s, probably in addition to their own. If you’ve dealt with one of the bad one’s however, you should talk to an attorney. A lawyer may be able to file a lawsuit for you that will recover financial damages for you and your child’s pain and suffering. Hopefully, you’ll never have to do this, but don’t hesitate if you do have to.
