When a Texas cerebral palsy lawyer sues a medical service provider it is usually because someone's child has suffered a birth injury that the lawyer and the parents believe is the result of medical negligence. Working with attorneys, or determining whether or not one could help you, requires that you understand a bit about this rather complicated concept.
Negligence: What it is and Isn't
Negligence doesn't mean what a lot of people think it means. It doesn't mean that the doctor was willfully lacking in keeping up with their duties to their patient. In fact, the doctor could have been trying their best to stop something bad from happening to a child and failed. The doctor is not being labeled as bad at their job, either. The doctor may be an excellent physician with a great track record and still be negligent in one regard or another. The key element in negligence is that the doctor could have been expected to do their job well and that they failed.
Negligence can also be on the part of the hospital or the nurses. An attorney will have to help you to determine where the fault actually lies in cases where cerebral palsy may be the cause of a birth injury. The condition lasts forever, so there will inevitably be problems that will require medical treatment. These treatments, of course, can be expensive and that means that some families will be in a fix where helping their new family member out is concerned.
Awards and Settlements
If a case goes well, the attorney may be able to get an award from a jury for your child's pain and suffering. They may also be able to get a settlement from the party that you're suing if the injury is obviously the result of negligence and if the doctor and hospital would rather just avoid the costs of paying for a trial. If a settlement is offered, be sure it is done through your attorney. There will be cases where the party you're suing will try to offer you a settlement without going through your attorney and this is a way for them to get away with paying less than they might otherwise.
Your attorney will have to talk to you before they can determine whether or not your case is likely to win. If it is, you may find that they want you as a client and that they will help you seek compensation.
