If daycare child abuse is discovered, filing a lawsuit will usually be something that parents will only think of after the criminal proceedings have concluded. It's almost certain that any instance of abuse in daycare is going to result in criminal charges of some type. It's perfectly natural to take some satisfaction in the fact that the people who committed the abuse against the children at the facility will be held accountable by the law. You may be suing for your own pain and suffering and other expenses, as well, but these lawsuits are all about providing for the children who are the actual victims of the daycare abuse.
Children who were in an abusive situation will generally need some type of counseling to get over the aftermath of it. It doesn't matter whether the abuse was sexual, physical or psychological. All of it has an impact and, to make certain that the child has a healthy outlook on life and that they have a good self-esteem, having them go to a qualified counselor is a good idea. This is not cheap and parents shouldn't have to pay for it themselves when the whole reason behind it was a negligent daycare facility.
You can also sue for pain and suffering. Of course, this isn't an expense that you can break down to a price tag readily. Your attorney will help you to determine a realistic amount to go after the facility for as far as pain and suffering is concerned. They'll look at other cases and see how much juries have awarded in similar situations to your own to determine how much you should sue for in regards to this part of the lawsuit.
If your child incurred medical expenses that were the direct result of them being abused at the daycare facility, you can most certainly sue over those, as well. In fact, this is one of the easiest parts of the lawsuit to put together. It's important to make certain that you have your doctor document any signs of abuse you find on your child so that you have something to stand on when you do go to court.
