Sometimes, you'll see lawsuits over dangerous drugs manifest in the form of class action lawsuits. These lawsuits are a specific type of legal action that allows the courts to remain free of thousands of different lawsuits and they're very popular for cases that stretch across state lines.
What Is a Class?
A class is a group of plaintiffs that have essentially the same complaint against a defendant. If your injuries that stemmed from the use of a dangerous drug mirror those suffered by those participating in the class action, you may do well to participate in it. An attorney can let you know whether or not this is your best option.
If your injures are not related to the reasons for the cases being filed in the class action, however, you may want to discuss filing your own lawsuit with your attorney. The attorney may be able to get your own lawsuit going and, if you're not represented by the class of people suing, this might be your best option overall.
Hiring an Attorney
You can use your own attorney, no matter what. When you start talking to an attorney about what you believe the bad drug did to you, the attorney will be able to determine your best option for proceeding with the case.
Make sure you deal with an experienced attorney. A good defective product attorney can make sure you get the best possible representation and that you have the best chances of winning your claim. That being said, there's no way to guarantee that you'll win your claim, even if you're sure that you have a good one. There are some instances where unsafe drugs do not expose the pharmaceutical company to liability and, because of that, there are cases where you might not actually have a lawsuit that's worth pursuing.
