Wyoming Lawsuit Nets Nine Million

The plaintiffs in a Wyoming lawsuit against a doctor and a healthcare provider came away with $9 million in damages as the result of a successful lawsuit. The plaintiff was injured in a rollover accident while working in an oilfield. The plaintiff had his neck broken and, as a result of physician negligence, eventually ended up losing the use of his left arm and shoulder.

Failure to Diagnose

The Wyoming lawsuit, to a large degree, was built around a failure to diagnose on the part of the physician. In this case, the plaintiff was complaining about pain in his neck, had just been in a car wreck but was not given the proper x-rays and other tests that would have let doctors know that there was a problem. The patient ended up suffering his disabilities as a direct result of the doctors not upholding their duties, according to the jury, and this triggered the $9 million award given to him in consideration of his pain, suffering and his injuries.

Failing to diagnose a condition is not always an instance of negligence. If the doctor had no way of really knowing that anything was wrong, medical malpractice might not be an issue.
