Alternative Medicine and Malpractice
There's a very grey area where alternative medicine is concerned. There are some procedures, such as those rendered by chiropractors and acupuncturists, that are generally accepted as having some valid medical application. Then, there are procedures such as reflexology, healing touch, polarity alignment and other procedures that either aren't accepted fully by scientific medicine or that are considered to be outright quackery by doctors with degrees.
Getting Information
You should get medical negligence information from a qualified attorney if you're wondering if you can sue an alternative practitioner for malpractice. The number of cases against alternative practitioners has gone up in recent years, so there is precedent for suing these practitioners for medical negligence. The hard part for malpractice attorneys will be determining exactly how your claim fits under the law.
If you were sold a quack product, you might be looking at a lawsuit for medical malpractice or you might be looking at a product liability claim. Your attorney will know for sure. If you were sold a quack procedure, you might be able to sue for malpractice. You might also have been the victim of fraud, which means that there's a criminal case involved, which will do nothing to compensate you, though it will take the fraudster out of the picture, if it's a successful prosecution for fraud.
Attorneys and Lawsuits
Many of the attorneys who argue medical malpractice claims have experience in other areas of the law, as well. You can consult with them to see exactly what kind of claim you have, if any. If the attorney you're speaking with only handles medical malpractice claims, they'll likely refer you to someone who can help. If they take other kinds of claims, however, they may be able to offer you a solution to your problem, even if it's not medical negligence that's the issue.
Filing a lawsuit is a big decision and you'll want to make sure you have the right attorney on your side. With the right attorney, you can handle just about anything thrown at you. Just make sure you're asking about the right kind of claim. Some alternative practitioners are liable under medical malpractice law and some may not be, depending upon what your situation actually involved. If you're interested in going ahead with a lawsuit, the first step is sitting down with an attorney, telling them about your situation and seeing how they might be able to help you.
