Negligent Drivers and Wrongful Death Accidents
Most people probably remember a pretty serious lecture from their parents when they first got their drivers licenses. These lectures usually include phrases such as "driving is a privilege not a right" and other statements designed to reinforce the fact that driving comes with a lot of responsibility. When you're on the road, you do have a reasonable expectation that the drivers around you, provided they have licenses, will exercise a certain amount of care for the other drivers on the road so that everybody is as safe as possible. Unfortunately, this isn't how things turn out all the time.
Negligence
Negligence on the part of another driver can sometimes cause the worst of all possible outcomes for the other people on the road. Negligent drivers are oftentimes named in wrongful death lawsuits. These lawsuits stem from the fact that, in the accidents over which they are filed, someone behaves in a way that the plaintiff and the attorney believes was negligent. Negligence on the part of another driver is cause to sue and, quite often, it results in a jury award for the party that does file a lawsuit.
Is it Incompetence?
Understanding how people when these lawsuits require that you understand the fact that saying somebody is negligent is not the same as saying that they are incompetent. Saying that they are incompetent would require you to establish that they have, in every instance, a marked lack of the skills necessary to perform the task in question. Negligence just means that they didn't exercise the precautions that they could've been expected to exercise or that any other reasonable driver could've been expected to exercise.
When someone doesn't live up to the reasonable expectation that we all have of other licensed drivers on the road, and when somebody else ends up getting killed because of it, filing a wrongful death lawsuit becomes an option. These lawsuits aren't filed to punish the other driver. They're filed to help the victims family deal with the tremendous financial burden forced upon them by the loss of a family member.
