There are instances where individuals receive excellent healthcare from their doctors but where the other support staff constitute enough negligence that the patient's health is endangered or, at the very least, they end up suffering significant financial damages due to loss of work or additional medical expenses that are incurred because of the negligent treatment they receive. One of the primary differences in suing physicians for malpractice and suing nurses or paramedics for malpractice is that the nurses and paramedics are generally under the direct employee of the hospital or other facility that delivered your care. In some cases, a doctor is under the direct employee of the hospital and in other cases they are contractors and are not directly under the employ of the hospital they work at. You will need to talk to qualified malpractice lawyers to determine whether or not you need to file a lawsuit against the healthcare facility or directly against one individual or another to claim compensation.

When to Sue

Only a lawyer can tell you when you have a good claim. If you do, however, they will still need to look over it to make sure that it's worth it to have it argued in front of the jury. Whether or not you actually win a claim is not up to the lawyer that you hire. It is up to the jury or, if the other party decides to settle, it is up to them to determine whether or not your claim is so strong that you deserve an award or settlement.

In some cases, you may not receive the entire award you are seeking from a jury. Most of the time, there are quite a few different parts that make up the total award and, in some cases, the jury may decide that you deserve some of the money but not all of it. The only way to know for sure, however, is to take a case to court and to have it heard in front of a jury and to see if they agree that the nurses or the healthcare facility was responsible for you receiving negligent care and if that was a direct cause of you enduring pain and suffering or financial damages that deserve compensation.
