What does Failure to Diagnose Mean?

A failure to diagnose claim may seem a bit ambiguous on the surface. After all, there are many different ways that a doctor could fail to diagnose a condition without being in any way negligent in the delivery of care. There are, however, standards regarding what doctors can be reasonably expected to know and what level of care they are expected to deliver.

What Failure to Diagnose Is Not

To fully understand how this type of common medical malpractice occurs. you must understand what a doctor is reasonably expected to do. The doctor relies on the patient to give them every detail about their overall health in order to give a diagnosis. For example, if you have a bad cough and do not let the doctor know then you can not hold them at fault for not asking you to undergo further examinations such as a chest x-ray. When a patient deliberately conceals something about their health, then the doctor can not be held responsible for not diagnosing a condition.

When a doctor fails to diagnose, it's generally because they fail to deliver an ordinary level of skill in their care. We do not expect doctors to be able to diagnose a condition in a patient when no symptoms are present, however, we do expect doctors to exercise at an ordinary level of skill or as any normal doctor could be expected to perform.

Diagnosis is a major part of the skills that a physician is taught when they go to medical school. Therefore, it can be expected that they should exercise a reasonable level of skill in performing their duties in terms of diagnosing conditions that may be a danger to the patient. If the physician failed to diagnose a condition and that led to you being harmed physically or financially, you may wish to consider contacting a medical malpractice lawyer.
