Medical Malpractice Claim | Selecting the Right Lawyer for Medical Malpractice Claims

If you’re considering suing a doctor or other healthcare provider for medical malpractice, you’ll need to make sure you choose the right Texas medical malpractice lawyer. You’ll want to look for some things in this lawyer to make sure that you have the best possible chance of winning your lawsuit.

The first thing you’ll need to do is to make sure that your lawyer has experience with these claims. Medical malpractice claims can be complex and pursuing them successfully means that the lawyer you choose needs to have some idea of how the law works as it applies to your case and how past cases may reveal how to hold the doctor accountable for the malpractice. Without an experienced attorney, the chances of actually winning one of these claims are very much diminished.

Honesty

A good attorney will just tell you if you don’t really have a valid claim. The best way to determine whether or not an attorney is being honest with you is to ask them if they work on contingency. Under one of these agreements, they don’t get paid if they don’t win your claim. As you may have guessed, this is powerful motivation for them to only pick cases they really believe in, and it ensures that you don’t get stuck with attorney’s fees for a losing case. If a good attorney doesn’t believe that they can help you, however, they’ll just turn down the opportunity to take your case. This is simply being ethical.

Intelligence

A good attorney needs to be sharp. They need to be able to find out what makes your case unique and also what makes it like all the cases that have come before it, and succeeded, at the same time. They need to take all of this information and put it in a form that they can successfully argue in front of a jury.

When you find the right attorney, you’ll have someone on your side that will represent you at every turn of the case. This means that you don’t have to feel alone when you’re facing down the defendant in court and that you won’t feel outmatched by the doctors or the healthcare facility that you’re suing. A good attorney inspires confidence in their clients by being qualified to take their case and to argue it successfully in court or to get a settlement out of the defendant.
