Who Is Liable for Medical Malpractice?
The classic medical negligence case is filed against a doctor that breeches their duty to their patient. There are cases, however, where the doctor is not actually the one who is sued. It depends upon who the person you’re suing works for and their arrangement with their employer. Generally speaking, however, medical negligence on the part of any medical practitioner or person employed in a capacity where they are responsible for treatment is something that can be sued over.
Hospital Employees
Doctors, of course, do not offer the greater part of patient care. That responsibility falls on the shoulders of nurses, who are among the most hard-working of all people in the medical field. Sometimes, however, these nurses end up being negligent in the delivery of care and, in those cases, they can be sued. They are not sued directly, however. The hospital that employs them is actually the target of the lawsuit in these cases.
Paramedics, like nurses, usually work for a hospital or other healthcare facility. They can also be incompetent or negligent at times and they can be sued in the same way that nurses can be sued. Both of these areas of employment generally involve an individual who is under the direct employ, and therefore directly insured by, the healthcare provider for whom they work. This is usually not true of doctors, however.
Suing Doctors
Doctors are generally under contract for the hospitals for which they work; they are not regular employees. This means that they are sued directly when they are responsible for some act of medical negligence. A lawyer will have to clarify for you the exact workings of your case but, if you have one, they will make sure that the right people are hit with the lawsuit.
Whenever you deal with medical malpractice attorneys, you have to make sure you always take their advice about dealing with the doctors or the healthcare facility that you’re suing. Physician malpractice cases sometimes involve the plaintiff being offer a settlement by the doctor or hospital named in the action, but you’ll want to make sure you ask your lawyer about whether or not any settlement offered is worth taking. IN some cases, the party offering it may just be trying to limit their liability to a sum they’re willing to pay rather than risking going to court and ending up on the hook for much more.
