Medical Malpractice | Why People File Malpractice Claims

medical malpracticeMedical malpractice lawsuits can be pursued for many reasons. In some cases, it represents a failure to diagnose on the part of the doctor that was attending the patient. It may represent an instance where something egregious occurred, such as someone being given the wrong surgery or having surgical implements left behind in their body after the wound was closed. It may even involve instances where dentists made errors that cause someone to suffer needlessly. The common denominator between all these is that a doctor does something incorrectly, incompetently or negligently in a way that causes their patient to suffer.

When People Sue

People usually don't sue out of a desire to punish the doctor, though that sometimes does play a part. Most of the time, they file a medical malpractice claim because the doctor's negligence caused them to suffer a specific financial or personal injury. The amount of money they seek in the claim is an attempt to compensate themselves for having had to endure those injuries and for the cost of medical bills. The plaintiff's lawyer will try to demonstrate how negligence did, in fact, to their client's suffering and how the client deserves to be compensated for the injuries and the monies that medical malpractice cost them.
