Birth Injury - Shoulder Dystocia

What is shoulder dystocia?
Dr. Henry Lerner states this term refers to when the newborn baby's anterior shoulder gets stuck behind the mother's public bone. Following this birth injury, 20 percent of all babies that suffer this difficult delivery will sustain a major birth  injury.

The most common injuries according to the doctor are:

  • Damage to the brachial plexus nerves
  • Fractured clavicles
  • Fractured humeri
  • Contusions and lacerations
  • Birth asphyxia.

In some instances, of brain injury can even occur, usually related to complications from birth asphyxia. Usually, malpractice lawsuits filed for a birth injury require that the doctor show negligence by:

  • Performing an unnecessary and dangerous act
  • Failing to take action to stop a predictable occurrence of shoulder dystocia
  • Falling well below the accepted standard of protocol during delivery.

Remember, shoulder dystocia is not an inconvenience-it can be a life-threatening condition caused by birth malpractice. If a doctor directly causes or negligently contributes to shoulder dystocia or even a brain injury, then you may have grounds for a lawsuit and will need a birth injury lawyer.

You may be entitled to compensation for pain and suffering, medical expenses, future medical care and prescriptions, loss of past and future income, psychological damages, reduced employment prospects, legal expenses and other losses.
