New Study: Texas Has Among the Lowest Surgical Error Payouts
At the American College of Surgeons (ACS) 97th Annual Clinical Congress, physicians took a close look at the surgical error information available in the National Practitioner Data Bank (NPDB). They shared their findings with meeting attendees as well as Medscape Medical News. Generally, researchers found that medical malpractice awards vary wildly by state, and that malpractice award averages often reflect an individual state’s laws.
When it came to the lowest medical malpractice payout amounts in the country, Texas was in the bottom four states along with Michigan, Kansas, and South Carolina. All four states have laws requiring medical malpractice damage caps – in Texas, a medical error victim cannot receive more than $250,000 in non-economic damages, no matter the details of their case.
The physicians who analyzed the medical malpractice data hope that the information they found will help correct issues in the current medical malpractice system and help both doctors and patients find just outcomes after a medical mistake.
