Nursing Home Negligence | 3 Steps to Take wth Elder Abuse
3 Steps to Take in the Event of Elder Abuse
If your elder has been abused at a nursing home facility or by a homecare provider, you'll need to seek help immediately. There is a very real risk that senior abuse can lead to a worsening of the conditions they suffer and, in some cases, the psychological damage can be profound. The first step in getting elder abuse help is talking to the right people.
Step 1: Contact a Physician
Your loved one's doctor has to be contacted so that they can get an idea of how their health may have been impacted by the abuse. In some cases, physical abuse may cause significant damage on its own and this needs to be addressed. It's important to remember that there are some physical abuse doesn't leave signs of it having happened in ways that are obvious to anyone but a medical professional and you'll want their assistance to assess the damage in full.
Step 2: Counseling
You may want to contact a counselor so that your loved one has someone to talk to about the incident. It may take them a long time to open up and, in some cases, they may never really want to talk about it. It's important to let them know that they're in charge of the situation. However they want to handle it is something that is up to them but it's good if they have a resource if they want to speak up.
Step 3: Legal Actions
There will be fallout from these incidents and they can be expensive. You're obviously going to need to move them to a new facility or to have a new homecare provider come in to take care of them. An attorney can help you with this, in some cases.
The attorney may be able to find out where negligence played a part in the abuse and be able to help you prepare a civil suit against the agency responsible. This means going to court, in some cases, though there is sometimes an offer of a settlement from the party being sued, as well. This can be a painful process and there is no guarantee that you're going to win. If you do win, however, you may receive enough money in compensation to pay for the aftereffects of the abuse and to help your loved one out in the future with their ongoing costs.
