Nursing Home Negligence and Abuse

Nursing home negligence does not always mean that there is abuse at hand, but allowing abuse to continue unabated may be construed as a form of negligence. Reporting elder abuse should never be something that is delayed in a nursing home environment. If a staff member is found to be abusive, it's up to the facility to make sure that the abuse is reported and that the staff member is removed from duty. There are cases, however, were abuses allowed to go on for a very long time.

Nursing home mistreatmentNursing Home Abuse is oftentimes not reported by the people who suffer it. Because these individuals are adults, they sometimes hesitate to admit when they're being taken advantage of by an abusive employee. This puts them in a situation where they are completely disempowered, if they have to fear retaliation from the staff member were they to report them in the abuse that their suffering. In some cases, it may be necessary for family members and even physicians to intervene to bring the abuse to a halt.

One of the best opportunities to establish that there is likely nursing home mistreatment going on is when the elder visits with their regular doctor. Because the physician will be aware of their patient's body, they will also be likely to spot anything that seems out of place. For example, physicians will be able to determine whether or not a bruise is something that is to be expected, given the elder's condition, or if it's something that seems completely out of place and that may be a sign that the elder is being abused. If you suspect that something may be going on that your loved one isn't talking about, talk to their doctor about the situation and asked them to pay extra attention for the signs of abuse.

If you're elder is being abused, the most important thing is to get them out of the situation as soon as possible. This, obviously, carries with it the potential for very high expenses. One of the ways you may be able to recoup these expenses is to file a lawsuit against the facility responsible for the abuse. In some cases, a jury may find in your favor and award you a substantial sum to compensate you for what you and your loved one have been put through due to the negligence of the facility.
