Product Liability | Four Loko Linked to Fatal Denton Crash

This past weekend, 14-year-old Valeria Rodriguez was killed when she was thrown from a Chevrolet Trailblazer in a car crash on her way to Oklahoma from Denton. Although the driver, 14-year-old boyfriend of the victim, was underage, the blame seems to be falling on the controversial energy drink, Four Loko, already banned in four states and sold in convenience stores.

Although the driver has already been charged with intoxicated manslaughter, he has admitted to drinking one can of Four Loko that night which has about as much alcohol as four beers. The drink has become popular with college age kids because of its cheap price and alcohol content level. Should the blame fall on the controversial energy drink? The TABC has already stated that it's not sure whether it has the authority to ban such a product and that it may have to an issue that the legislature has to consider, but the lead that the other four states have taken may pose a product liability to the company.

Manufacturers have the obligation to inform their consumers of the dangers involved with their product with clearly marked labels. Otherwise, severe and ghastly consequences can take place, which in this case, involved death. In the case of Four Loko, it's still being discussed whether or not Four Loko had the obligation to do so for their product.
