Texas Court Grants Injured Man Workers’ Comp Benefits

The Texas Supreme Court has sided with a woman who is seeking workers’ compensation following a serious car accident that took place in Austin in 2003. Initially, a jury sided with the injured woman, but an appeals court reversed the decision. Now the TX Supreme Court has ruled that the worker does indeed deserve workers’ compensation for her injuries.

Liana Leordeanu worked from home as a pharmaceutical salesperson. One day she was driving to a storage unit owned by her company in a company car when she was seriously injured in an accident. Her organization’s insurance company, American Protection, argued that she did not deserve compensation because she was commuting and not on company business at the time of the car crash. The Supreme Court Justices decided that since she was driving from a business dinner to a company-owned storage facility to deliver business supplies before returning to her home office to work, she was indeed on the job at the time of her injuries.
