Texas Liability Lawyer | When Drugs Turn Out to be Dangerous

When Drugs Turn Out to Be Dangerous

Unsafe drugs are probably the most terrifying of all defective products. Not only are drugs taken with the full trust and confidence of the patient, they've also been approved by the FDA if they're on the market. It's always a surprise when drugs turn out to be dangerous. In some cases, it turns out that the company that manufactured the drug knew that it had certain side effects and opted not to say anything about it. In other cases, it turns out that the drug proved to be dangerous even though it was tested and approved by the FDA and is immediately withdrawn from the market.

Unsafe DrugsBlack Boxes

Some drugs receive what is called a black box. These drugs are known to have side effects which may be life-threatening. The side effects can range from things such as heart problems or blood clotting to psychological disorders that are brought about by the use of the drug. In any case, a black box is a warning that is given to the patient that the drug is, in certain regards, unsafe. Product liability lawsuits are generally filed when someone has not been warned of the dangers of a drug or when they were told that a drug was safe and it turned out not to be.

Side Effects

Any drug is going to have side effects. In fact, side effects are just effects of the drug that have nothing to do with the treatment for which the drug is being used. As long as you are warned about all the possible side effects, you can make a decision as an informed consumer about whether or not you want to take the drug. When you are not warned, you can end up in a situation where you are taking far more risk than you consented to. Filing a lawsuit to help you pay for the fallout is one of the options you have in these situations.

Lawsuits

Product liability lawyers in Texas can take a look at your situation and determine whether or not a lawsuit is merited. It will not always be an option. If the attorney believes that you were not fully informed of all of the potential dangers of the drug or if the drug has turned out to be the subject of other lawsuits, they may recommend that you go forward with your own legal action. Some drugs end up being subject to class-action lawsuits, as well.
