Texas Man Sues Trucker For Slew Of Violations After I-35 Accident

According to the Southeast Texas Record, a Texas man is suing a Dallas trucker and a truck company following a rear-end accident on Interstate 35 outside of Gainesville. The Cooke County lawsuit states that the accident took place in June 2009 when Christopher Leigh Hudson was struck and injured by a big rig driven by Enrique Humberto Sanchez and operated by Southeastern Freight Lines Inc. The truck accident occurred when Hudson slowed his vehicle to conform to traffic, but Sanchez did not slow his tractor-trailer.

Hudson is seeking damages for medical costs, pain and suffering, disfigurement, impairment, lost wages, mental anguish, court costs, and interest.

The traffic accident lawsuit contains a laundry list of accusations, including:

•    The trucker did not properly secure his cargo.
•    The trucker did could not read road signs.
•    The trucker failed his driving test.
•    The trucker was under the influence of drugs or alcohol.
•    The trucker falsified his driving logs.
•    The trucker drove for more time than trucking regulations allow.
•    The trucker failed to drive with a high degree of care.
•    The trucker failed to maintain an appropriate distance between vehicles.
•    The trucker was following too closely.
•    The trucker failed to maintain a reasonable speed.
•    The trucker failed to control his speed.
•    The truck was speeding.
•    The trucker did not keep a proper lookout.
•    The trucker did not stop driving when mentally or physically unfit.
•    The trucker failed to brake.
•    The trucker failed to avoid the accident by swerving.
