The TIME to ACT is NOW.

A medical malpractice law firm handles cases where doctors breech their duty to their patients. This can take numerous forms. In many cases, it is simply neglecting to carry out their duties at all, rather than any specific type of incompetence. In other cases, genuine incompetence is involved. The thrust of all these cases can generally be understood as having four points on which they’re built. These points are actually quite easy to understand.
The first thing that defines a medical negligence case is that the doctor had a duty to the patient. This is implicit whenever a doctor agrees to treat a patient at all. The lawyer will then prove that the doctor failed in this duty. This still does not make a medical malpractice case, however. There has to be real harm done to the patient. It also has to be established that any harm that the patient suffered was, at least in part, due to the negligence on the part of the healthcare provider. In many cases, the fourth part of this process is the hardest; assigning an amount to the damages.
In order to sue for malpractice, law firms have to be able to attach a dollar figure to the damages done to the patient, as well as their pain and suffering. You don’t have to pull out an arbitrary figure, however. There are most often other successful cases that can provide an idea of how much in damages you may be owed. Your greatest asset in this regard will be the experience your attorney has working with these cases. It helps them to get a realistic idea of how much money you may be owed. These cases sometimes don’t even go to court. In most cases, you’ll be suing the doctor’s or hospital’s insurer for the damages.
Some medical malpractice lawyers will be able to get you a settlement. There may be an offer soon after you’re ready to file your case. The insurer, in these cases, believes it would be in their interests to pay you out of court. This means you never go to court to have your case heard. In some cases, settlements can be very substantial, as the insurer has a vested interest in not having the case go to trial. If it does go to trial, you’re attorney will put together everything that’s needed.
