What is a Medical Malpractice Settlement?
There are instances you've probably heard of where a medical malpractice claim has been resolved as a settlement. In these instances, the plaintiff is offered an amount of money by the defendant as a way of avoiding going to court. There are actually very good reasons that people opt to take a settlement rather than going to court. Here are some of the things about settlements that make them a good idea, under certain circumstances.
The Benefits
The benefits of a settlement are financial. The defendant gets two things, at least, out of a settlement. First, they get to offer an amount that's less than the award being sought. This limits the amount that they'll have to pay for the claim. Second, they get to avoid going to court, which could cost them a lot of money.
The benefits to the plaintiff, in part, include similar ones. The plaintiff doesn't get everything they're asking for, but they at least get an amount they consider fair compensation and don't have to chance a jury not awarding them anything. The plaintiff also avoids paying the costs of going to trial, and this is just as important to them as it is to the defendant.
How Are They Offered?
A medical malpractice settlement will be offered at some point before the trial, sometimes very close to the trial and sometimes right away after the claim is filed. The settlement will be offered to your attorney and your attorney will discuss it with you to see what you think. If the amount being offered is close to what the attorney thinks is a realistic amount for you to get from a jury, they may recommend that you take the settlement. If not, they may ask the other party to offer more. Ultimately, however, the decision is up to you. Your attorney is there to advise, not to dictate.
