Texas Woman Sues Hospital After Daughter Suffers Birth Injury

According to the Courier-Gazette, a Texas woman has filed a medical malpractice lawsuit against a hospital that released her from their care while she was in active labor. The woman had to give birth to the child at home and the child suffered permanent injury.

The birth injury lawsuit was filed in the U.S. Eastern District of Texas court against the Medical Center of McKinney (MCM) by plaintiff Wendy Cherry, who has hired a Dallas birth injury law firm to help her with her case. Cherry says that she went to the hospital with severe abdominal pain on February 4, but was turned away by the hospital staff without getting a proper examination or evaluation. When she was forced to give birth to her daughter, Emma, at home, the baby suffered an injury due to her delayed birth.

The birth injury lawsuit states that the baby would not have been injured at birth if the labor had taken place at the hospital that discharged the mother during active labor.
