You Worked for it, it's Yours
The vast majority of Americans work as an employee in a job where they're paid salary or hourly wages. If you're one of these individuals, you need to start seeing yourself as a businessperson as, in reality, that is exactly what you are. You're selling your labor on the market and, when you provide the services you offer, you're entitled to be paid for as much. Unfortunately, some unethical employers will try to scam you out of money by saying that you're not eligible for overtime or by simply shorting your paycheck outright.
Avoiding this starts with keeping paperwork. Document all the hours you work so that there is a paper trail. Make sure that you get a copy of any and all contracts and other paperwork related to the terms of your employment. There is something to be said for trust between employer and employee but, when it comes down to it, this is a business arrangement. Good contracts make good business relationships and you have to hold on to a copy of any that involve you and your work for an employer. This includes pay stubs and everything else.
If an employer tries to short you on wages or overtime and you have this documentation, it's fairly straightforward. The law is most certainly on your side in this instance. Wages and overtime are governed by the Fair Wages Standards Act. This law ensures that employers do not have a loophole whereby they can avoid paying working men and women what they're due for their services and labor. Unfortunately, many workers do not know these laws and, therefore, many of them are unknowingly paid far less than the wages they've earned through their sweat. A good lawyer can make sure you don't fall prey to this.
