If the other party does offer a settlement, the attorney will confer with you and make sure that the sum is acceptable to you and let you know whether or not it's likely that you would do better to go to court.

No attorney can predict that any case is going to win. There are instances where cases that seem very good aren't persuasive to a jury. To maximize the chances that your case will be persuasive to a jury, make sure you hire an attorney who has experience with this area of the law. It ensures that you're getting the most for your money and they have the best chance of coming away with a jury award or settlement. Any attorney who tells you that your case is guaranteed to win is someone you may not want to work with. A good attorney will let you know if they feel that they can help you and will do everything they can to argue your case successfully.
