Are there a lot of frivolous car accident lawsuits?

People get plenty of bad information about lawsuits and the people who file them. Oftentimes, this is because the lawsuits are cast in a way that makes it sound like the person who was injured took their wreck as the equivalent of winning the lottery and decided to take their prize money out of the other driver. This is not what a car accident lawyer helps their clients to do. Before you dismiss someone’s car accident lawsuit as frivolous, understand that there are always two sides to every dispute.

Minor injuries.

Putting aside those cases where someone is seriously injured or killed, consider the financial impact of even minor injuries. These may require a trip to the ER, and you may find yourself parting with thousands of dollars for that alone. The injuries may also require repeat doctors’ visits for treatments and, especially if you’re one of the millions of Americans who have no health insurance at all, you know how much that can cost.

Loss of vehicle.

Losing your vehicle is not like losing a recreational toy. Most people depend on their vehicles to get to and from work, to take care of necessary errands and, for people who live on the outskirts of the city, it’s almost impossible to get by without one. When someone destroys your vehicle, it can take many years to get the money to buy another one, especially if you’re dealing with the aforementioned medical expenses.

Loss of work.

The money you lose when you’re out of work can have a significant affect on your family’s financial security. Many of the people who are injured in a car wreck are out of work for a long time and this is a big part of the reason that they sue the other driver; for lost wages.

It’s not frivolous to hire a Dallas personal injury lawyer to represent you if you were hurt in an auto wreck. In fact, it may be the only smart move you have available to you. When another driver is negligent and they cause you financial and physical harm because of it, there is little other recourse than to file an insurance claim. When the insurance company denies that claim or offers a low ball settlement, your only recourse is to file a lawsuit.

Remember, when you hear about someone winning a lawsuit, it’s not like they just won the lottery. Both sides argued their case in front of a jury of their peers, and that jury determined how much they should get as an award. Even if you don’t agree with the result, understand that you were not on the jury. You simply don’t have all of the information.
