The Role of the State and Your Lawyer in Daycare Abuse
If you're involved in a situation where your child is a victim of daycare abuse, the role that the state and that any lawyer you hire plays are very different. There are instances of daycare abuse reported in the media all the time. One of the things that you'll notice is that there are usually two major events that the media reports on in these cases. First, the criminal case; second, the lawsuits that follow it.
The State
Part of the responsibility of the state is defending the rights of children. When children are victimized by a molester or an abuser, the state will step in and press charges against the person. The person accused, if they're guilty, will be punished and, ideally, reformed through the system. This is justice, according to the way that most people think. There is something missing from this picture, however, and this missing element is what civil law seeks to provide. The families of the victims and the children who are victimized receive no compensation for what they've been through because of what the criminal justice system does.
Your Lawyer
Perhaps there is some notion of justice that's satisfied when someone is sent to jail for committing a crime, but the notion doesn't take care of practical realities. There's a very good chance that any child who was abused is going to need some sort of psychological care. It wouldn't be unusually for the whole family to want some help in dealing with such a difficult situation. The pain and suffering that the child is put through is also very real. Your attorney will help you to determine a good amount of damages to seek based on your situation and will help you sue the daycare that perpetrated the abuse or that allowed it to go on.
Does a lawsuit ever really completely erase the pain of a daycare abuse case? Of course not. The point is that they provide a practical way for families that have been victimized to heal. The company that let abuse in daycare go on under their watch deserves to be sued, according to how many people think in these instances, and that is another reason that parents sometimes go after them. The criminal justice system might deal with one aspect of these cases, but lawyers exist to make sure you are served justice, as well.
