What is Product Liability Law?
Product liability law exists to make sure that people out there making a buck don’t hurt or injure people in the process. It protects consumers in several ways and, when someone gets hurt because of a faulty product, it gives those consumers options to redress the situation. In some cases, consumers are able to sue manufacturers for defective products that cause damage to their property or injury to their person.
Whenever a product is put on the market, the manufacturer is responsible for the design, production and marketing of that product. The design must be safe, the manufacturing standards have to consider the safety of users and the marketing must be accurate and faithful to the actual uses for the product and the dangers presented by it. Some products are dangerous by their very nature. In these cases, the consumer is protected by warnings that tell them how to use the product safely. An air rifle, for instance, comes with a lot of literature, engravings and stickers that warn you not to shoot it at other people, animals or at surfaces that may cause a ricochet.
When manufacturers fail in some regard, people are sometimes hurt. If the air rifle, for example, didn’t warn someone that they should wear eye protection when they used it and if the advertising implied that it was perfectly safe to shoot indoors, the manufacturer may find themselves being served with a lawsuit from someone who lost an eye shooting indoors. If there was adequate warning given and the consumer hurt themselves because they ignored the warnings, it’s not the manufacturer’s fault, in most cases. You have to have been using a product according to the directions in order for these cases to be viable, in most instances.

Contrary to what the media tends to concentrate on, many of these suits are very understandable and the people who filed them were grievously injured by the products they thought were safe. The laws that govern product safety are there to protect you and to make sure that irresponsible manufacturers can’t get away with hurting people to make a profit.
