Hurt by a defective product? Here’s what you need to know

Defective and unsafe products are everywhere - even where people least expect them to be. Cribs, children's toys, outdoor furniture, vehicles, medical devices, food and drinks - all of these things can hurt or kill consumers.

If you or a family member are injured or killed by a defective product, then by law you can hold the manufacturer, designer, seller, distributor or anyone else involved in the product's supply chain accountable. Here is some basic information to help you pursue justice in your product liability case.


What should I do if I was injured by a defective product?
If you are hurt because of a defective product, collect and keep as much evidence as possible. Try to preserve the product as best you can in the same condition it was in when the accident happened. If the product is in pieces, make sure you have all the pieces. If at all possible do not disturb the site where the accident happened so that evidence can be gathered.

Keep a record of the product name, the manufacturer's name, the model and serial number of the product, where you bought the product and when it was bought. Also hold on to any packaging and instructions for the product.

How do I prove that a manufacturer was negligent?
You don't actually have to prove that the manufacturer of a defective product was negligent. By law, if a product is defective then the manufacturer can be required to compensate you for your pain and suffering, disability, medical expenses and lost wages. In addition, other companies or individuals involved in making the product available for sale can be found liable.


Do I need a lawyer if I was hurt by a defective product?
