Will Product Liability Law Cover Property Damage?

Yes. Product liability law will apply if a product causes you no injuries and only causes property damage. The most obvious example of this is the fact that automobile manufacturers have been held responsible for cars that were simply defective, but not necessarily dangerous, in the past. Manufacturers are most certainly responsible for any products they put on the market and, if you believe that your money was spent on something that did not perform as you expected it to, or on something that ended up causing damage to your property, you need to contact a defective products attorney.

A good attorney will have to figure out whether or not the manufacturer can actually be held liable for whatever damages you suffered. For example, some products are simply inherently dangerous. If you were shooting and air rifle in your basement and it ended up damaging your property in some way, the manufacturer is likely not vulnerable to being held liable for that. In fact, most dangerous products carry enough warning labels that people should be well aware of the risks that they present. There are cases, however, were people are unaware of the risks they present.

Another example of how product liability law can apply to financial damages, rather than just to physical damage, can be seen in a case that's currently being heard in San Francisco against Dell computers. The computer manufacturer is being sued for how they reacted when products were reported to be faulty. Because the manufacturer makes personal computers, it's obvious that there was really no physical injury to anyone involved. When you do spend money on a manufacturer's products, however, you have a right to assume that you're spending your money on something that was designed to work well and on something that will be backed up by the manufacturer if it proves to be faulty.

Talk to a lawyer if you believe that you've been ripped off by a manufacturer in terms of quality or if you believe that a flaw in their product led to direct damage to your property. If it turns out to be the case, you may be able to file a successful lawsuit against the company and recover damages. Only a lawyer can tell you this for sure but, many of them offer free consultations, so there's no risk in asking them.
