Filing a Suit for Abuse in Daycare

Abuse in daycare can be one of the most horrifying things a parent or a child ever faces. Whether the abuse is physical, psychological or the result of neglect, the consequences can be severe. In some cases, the parents of the child that was abused will face medical costs as a result of the abuse. In others, there may be counseling needed to help heal the scars inflicted by the abuse. There are options for those who have faced this nightmare down. Among them is hiring an attorney and filing a lawsuit against the offending facility.

Daycare child abuse sometimes goes on for a very long time. Some abusers are very good at getting away with their crimes. If you suspect there may be something going on at your facility, speak with other parents. Having another parent’s input on the situation may prove useful. You can also make an effort to talk to your child more often and in more detail about their experiences at the daycare. Some children are naturally resistant to going to daycare, but if they’re excessively resistant to it, to the point of seeming scared, there may be a problem.

If daycare abuse has already been discovered and your child has been a victim of it, you may want to seek out the services of an attorney. There are attorneys out there who have expertise in this area of the law and who are willing to help those who have been victimized by bad daycare facilities. There is sometimes a statute of limitations that applies to these cases, so it’s best to speak with one of these attorneys sooner rather than later. They sometimes offer a free consultation, which is part of a contingency agreement. Under such an agreement, you pay the attorney if you win your case or if they negotiate a settlement with you. If not, you pay nothing for their legal services.

The attorney will prepare your family to testify about the abuse in daycare that your child suffered or witnessed. This process can be difficult, but there may be a jury award handed out that could help you pay for the costs of having lived through this, as well as for your pain and suffering. If there is, the attorney will take their pre-disclosed legal fees out of this amount, and not charge you any otherwise.
