Three Signs of Nursing Home Abuse

It's not always easy to detect senior abuse. Sometimes, a nursing home resident is their own worst enemy when suffering from abuse because they will not talk about it. But while this makes it difficult, it is not impossible to spot negligence and abuse in nursing homes. Here are 3 signs to be on the lookout for when you've placed your loved one in a healthcare facility.

Senior Abuse

Fear

If your loved one exhibits genuine fear of one of the staff members, this is a major sign that something is wrong. It is likely that your loved one will try to hide any fear they have from you, but there are some things to look for. Keep an eye out for flinching around certain staff members. It is also important to trust your instincts when you feel that someone does not like your loved one, and that your loved one does not like them. It is not always easy to detect these situations, but there is usually some indication that something is wrong.

Depression

A sudden decline in the psychological health of your loved one is one of the biggest signs that something is very wrong in the facility. Nursing home abuse does not always occur physically, but often the abuse is psychological. Depression can be a sign that your loved one is being humiliated or intimidated by a staff member. This has a negative effect on anybody's self-esteem and it's usually something you can see in their attitude.

Withdrawal

When somebody is in a nursing home, there is really nowhere they can hide from the staff. In order to protect themselves, someone who is being abused may psychologically withdraw. If it seems like your loved one isn't making effort to connect with the other people at the nursing home, or that they're suffering from severe feelings of isolation, the isolation might be self-imposed. It is very important to investigate whether or not what's going on is some sort of defense mechanism to protect them from the pain of being abused.

When your loved one is being abused in a healthcare facility and the administration failed to intervene, you should contact a nursing home abuse attorney. This is a form of negligence and, if it happened that that negligence put your loved one in harm's way, you may have the option of filing a lawsuit to seek compensation for their pain and suffering.

When Hiring an Attorney

When selecting an attorney to represent you and/or your loved ones, it is important to know how many victims your potential lawyer has represented.  We always encourage you to speak to speak with as many lawyers until you feel comfortable – after all, the lawyer you hire should answer your questions, be available to speak with you and provide you with clear, honest and direct answers.

Ask the lawyer you are thinking about hiring:

  • Whether he or she has ever been recognized as one of the best attorneys in their field by his or her peers

  • What type of ratings they have attained from Martindale Hubbell or AVVO

  • Whether he or she has handled the particular type of case in which you want to hire him for

  • Whether he or she has ever written any books on the subject for which you are hiring them

  • How often they are called upon the press and news media to provide analysis on the issues involved in the type of case you want to hire him or her
