The Legal Perspective of a Personal Burn Injury

Fighting Fire With Fire

fireA burn injury refers to external damage that has affected your body's tissues. According to Medline Plus there are three degrees of burns: first-degree burns which only damage the outermost layer of skin; second-degree burns which damage both the out layer and the first internal layer; and third-degree burns which damage or destroy the deepest internal layer of skin and the surrounding tissues.

Burns can be caused by a variety of means, including excessive heat, chemicals, electricity, radiation or even sunlight. Though burn injuries are usually thought of in a context of work-related injuries, people can suffer personal injury resulting from hot liquids, steam, building fires, flammable liquids and gases. In extreme cases, third degree burns have let to critical scarring, infection, shock and even death. After suffering a third-degree burn you must undergo skin graft treatment, as the burnt skin will never completely heal on its own. However, first and second-degree burns can heal with the aid of antibiotic creams.

According to the American Burn Association500,000 cases of severe burns are reported each year. Of these half a million cases, there are 4,000 deaths reported as direct result of a burn injury. Seventy-five percent of all deaths occur immediately after the injury is sustained.

Burn injuries are astronomically expensive to treat and can make surviving a life-threatening burn a bittersweet experience. Prolonged hospitalization for third degree burns can exceed $100,000. Understandably, many burn victims want compensation for their medical treatment and pain and suffering if they were not at fault.

However, who can you blame in a burn injury? Personal injury lawsuits can only be filed against plaintiffs who have suspected liability. From that point, the plaintiff will have to prove that the liable party acted negligently and that the injury was the direct result of a person's action or inaction.

Personal-Injury-Info.net explains the four elements involved in personal injury cases:
  • · Duty
  • · Breach of Duty
  • · Direct or Proximate Cause
  • · Injury

The plaintiff has to show evidence that the liable party had a duty to protect the innocent burn victim and that the duty assumed was breached. Next, direct or proximate cause must be proven. This means that a lawyer must prove that the burn injury happened directly as a result of the liable party's action or indirectly, as suggested by "proximate clause." The severity of the injury must also be proven, as this will directly influence the amount of compensation that is eventually given to the plaintiff.

What are some burn cases in which a personal injury or wrongful death claim could be filed? An employer could be sued for a burn injury, as well as the manufacturer of a defective product or a utility company. A property owner, vehicle owner and driver of a vehicle assume responsibility and thus can be held liable for burn injuries, if proven to be negligent. A worker who services a vehicle or a piece of dangerous equipment can also be held liable.
