Are Product Liability Lawsuits Frivolous?
The media has done a fine job of making it look like most product liability suits are ridiculous and opportunistic. This is not at all the case. Product liability law exists to protect everyone. It doesn’t provide a get-rich-quick scheme for those who are always looking for a way to sue, however. These laws are designed to make sure that consumers have a safe marketplace where they can buy goods with confidence. There are several different factors that can define a product as defective. When they are judged to be such, you may be able to get compensation for any pain or suffering those products have caused you.
As an example of this, consider the much-maligned toy known as lawn darts. These were on the market for many years in the US. Advertised as a fun game for children, these were essentially javelins that were thrown upward and aimed to land within a scoring area. Anyone who’s ever handled a bow will tell you that shooting arrows into the air is the most dangerous thing you can do, aside from aiming at someone directly. This is essentially what children were being encouraged to do with these toys and injuries resulted. Product liability law helped get those dangerous products off of the market.
In some cases, a product is not inherently dangerous, but it is not adequately labeled as to what hazards it does present. Consider a radio without a warning tag that reminds users to keep it away from water. This may be obvious to an adult, but a younger individual may not think about what could happen if they use their radio in the bathroom. The amount of warning labels on products may seem silly at times, but remember that they only seem that way because your experience and knowledge inform you of the risks they describe. For some people, those labels contain new information.
