Finding Out if a Product was Defective

In some cases, when you're injured by a product that proved to be defective, it will turn out that you weren't' the only one. One of the ways you can find out about this is to speak with a defective product attorney to see if they know of other cases involving the same product. In some cases, they very well may and may be able to help you by working up a claim for damages for you.

How it Works

A product is deemed defective if it meets at least one of three criteria.

  1. It was advertised falsely
  2. It was manufactured defectively
  3. It was designed defectively

If it meets one or more of these criteria, you may be able to file a lawsuit for damages. Whether or not you win the case, however, depends on how a jury regards your case. They may find that the manufacturer does owe you for the damages you've suffered or they may find that the manufacturer owes you nothing at all. There's no way to tell, however, unless you actually go through with filing a claim. Your attorney will be able to tell you whether it's worth it or not to do so.

Contingency

One of the ways you can tell if a lawyer actually believes in a case is to see whether or not they'll take it on contingency. This means they're not going to get paid unless they win. Like everyone else in the world, lawyers do prefer to get paid for the work that they do and they're unlikely to take a case if it seems like it's going to lose. Ethically, any lawyer will tell you if they think they cannot help you and, if this is the case, they'll usually tell you to either look elsewhere for representation or, simply, that the case isn't likely to be worth your expenses.

Filing

If the lawyer wants to take your case, the process starts with sitting down with them and giving them your entire story. The lawyer will do a lot of additional research to back up your claim and will help you to prepare for court. If you end up needing to go to court, the lawyer will make sure you know what to expect and will argue so that your product liability lawsuit has the best chance of winning in front of a jury. A settlement may also be offered by the party you're suing.
