What Everyone Should Know about Product Liability Law
Product liability law is designed so that manufacturers are held accountable in the event that their products harm someone. Because this is a legal area, it is very important to understand how certain words are used when describing product liability. For example, when the courts find that a product is defective they are actually saying that the product is dangerous when it is used as directed by the manufacturer. There are three specific types of situations where product liability law may come into play, and where you may file a lawsuit.
1. Manufacturing Defect
A manufacturing defect occurs when something in the manufacturing process of the product makes it dangerous to use as intended. It may be that the factory used chemicals that were dangerous, such as in the recent case where baby toys were found to have been painted with lead paint. For example, this is also the type of product liability law that comes into play when a car manufacturer releases a car on to the market that was manufactured incorrectly. 2. Design Defect
If the manufacturer failed to notice that something in that design of a product is dangerous, this design defect may make them liable in court. However, for a lawsuit to occur the design defect has to hurt somebody or cause them financial harm.
3. Marketing Defect
An example of a marketing defect would be when the product is advertised as being safe for a certain purpose and then turns out to not be safe at all. An example of this type the defect would be toys that are advertised as being safe for certain age range and which are later found to pose a specific hazard to children within the age range advertised.
Having attorney file a product liability lawsuit for you is the first step in getting compensated for any damages a faulty product has caused. This can be a complicated process, and it must be determined whether or not you were to blame for your injuries. Most of the time, a faulty product results in several lawsuits and they are sometimes combined into one large lawsuit called a class-action. Individuals can bring their own lawsuits, however, particularly if the injuries they suffer were markedly different from those suffered by the people involved in the class-action lawsuit.
