A circular saw, handgun and a knife are all items that are expected to pose a certain amount of threat to their users. However, there is such a thing as a product that poses a risk that is unreasonable. Oftentimes, this happens when a product is manufactured in a defective way. It can also happen because a consumer was not adequately informed of the risks presented by the products they were using.

A manufacturer is obligated to provide a product that is reasonably safe, that is manufactured in a way that guarantees that it performs as expected and that is advertised in a way that openly states any risks that it poses to the user. Though these ideas are specific and legal, they’re really nothing more than the basic rules of fair play. Product liability law firms handle a lot of cases where companies don’t stick to the rules of fair play. Sometimes companies do this because they weren’t aware that their manufacturing process was flawed and, in other cases, they do it because it’s more profitable for them to take chances with other people’s lives.

If you’ve been injured, you’ll have to establish that you were using the product in a way that was implied to be reasonably safe. For instance, if you were driving a car, going the speed limit and weren’t intoxicated and a mechanical failure in the vehicle caused you injury, you’d be wise to look into a product liability lawsuit. If you were speeding, however, or pushing the car beyond the boundaries that it was intended for, it’s your responsibility if you get hurt. Your misusing a product is not the manufacturer’s problem.

Product liability law is there for you so that you can be on equal footing with the manufacturers who make consumer products. It’s designed to make sure that the same rules apply to everyone and that no one is at a disadvantage. It doesn’t matter if the company is a small firm or a multi-national conglomerate, the law applies equally to them.
