What are Product Liability Suits About?

Product liability lawsuits are oftentimes equated with frivolous lawsuits in the press. This makes for interesting, but not entirely accurate, reporting. Many lawsuits filed against companies for damages caused by their products involve circumstances that would truly surprise people. People have been grievously injured by products in many different ways and, in many of those instances, they had every reason to believe they were safe because, in one way or another, they had been led to believe as much. The company may have marketed a product for a purpose that was not safe, have had a defect in the design of the product that made it dangerous or have manufactured the product with a flawed process.

Product liability law allows consumers to hold companies accountable when a product’s advertising is not accurate in a dangerous way. If you look on most electrical appliances, you’ll see tags that warn you to keep it away from water and about other hazards that the product poses. Those tags are there because the company is taking their responsibility to their customers seriously. In some instances, companies have sold products that have injured or killed people who may not have used those products had they known the risks. Lawsuits over pharmaceuticals that proved dangerous are good examples of this.

Product liability law firms specialize in pursuing these cases. It takes some expertise to pursue these cases successfully. The attorneys have to establish that the consumer didn’t endanger themselves in some way by using the product against its directions. In some cases, there may be risks posed by the product that were never published before a lawsuit is brought, which means that there may be extensive research time involved in building a case. Some attorneys do this work for no upfront cost.

If you’re considering filing a product liability lawsuit, keep a few things in mind. If you were using the product in a way that the manufacturer specifically warns against, you may not have a case at all. Not every lawsuit will win. There are many instances, however, where consumers have managed to expose the shady practices of a company where marketing or quality control are concerned through a lawsuit. Some of these lawsuits have paid out very well, which is not too surprising when you look at how badly people have been injured by products that were dangerous from the start.
