Does Product Liability Always Involve an Injury?
Not every product liability claim actually involves an injury. In some cases, these claims are filed over property damage. For example, cases where coffeemakers with automatic turn on and shutoff switches have ended up causing fires haven't always injured anyone when they did burst into flame. In some cases, they simply destroyed property and the people who filed lawsuits filed over that destruction, not over being injured by the device.
No Damage
There are even claims filed against companies when a product that they sold didn't actually deliver what it was supposed to deliver. The company can be held liable when advertising for product overestimates what it actually delivers. There have been cases concerning Internet service providers over these claims and other types of cases where a product was claimed to deliver a certain level of service and it was found that it never actually did deliver that level of service consistently.
With Injuries
The most famous product liability claims are generally those that actually do involve somebody being injured. These involve cars that turn out to be hazardous, hardware that turns out to break or fail when it is used as directed and toys that turn out to be sometimes deadly to the children who play with them. These cases get the most attention in the media, simply because they have a sensational nature to them. If you believe that a product that you are sold simply underperformed, however, there is no reason that you shouldn't consider whether or not an attorney may be able to help you file a lawsuit against the company that provided it. In some cases, these claims can end up netting you quite a bit of money or, at least, they could provide you with enough money to make up for what you spent on the faulty product.

Product liability law is something of a specialty field, so make sure that you speak to a qualified attorney if you are considering pressing one of these cases. The attorney will be able to tell you whether or not it seems likely that you have a case that is worth pursuing. In some cases, it may turn out that you do have such a case and that you could potentially get a nice settlement out of taking the company to court over the matter. There is no way to guarantee this, of course, but an attorney can at least tell you if it's worth a try.
