Wrongful Death and Hospitals: How it Happens

When you're talking about medical malpractice law, it's important to keep in mind that most doctors and hospitals work very hard to provide good care for their patients and to provide a safe environment in which they receive that care. There are situations, however, where things go out of control or where somebody doesn't live up to those duties and when it ends up claiming a life. There are several factors that play into high infection rates in hospitals. Some hospitals simply fail to live up to the high expectations that are placed upon them as far as hygiene is concerned. There are also factors that have nothing to do with the hospital. For example, the overprescribing of antibiotics has resulted in strains of bacteria that are highly resistant to antibacterial treatments. In some cases, coming down with an infection with this type of bacteria can prove deadly to people who are already convalescing from a major medical event.

Negligence

In some cases, the hospital or healthcare providers who work at the hospital are simply negligent. They may fail to deliver care up to the standards that the patients have a right to expect and, because of that breach of duty, somebody may well lose their life. Negligence is actually the reason behind medical malpractice claims. A lawyer will try to establish to a jury that the healthcare provider was negligent in some regard and that their client came to harm because of that negligence. Negligence can take many forms and can be expressed in many different actions or the lack of intervention at a time when it was sorely needed.

Wrong Diagnosis

Getting the wrong diagnosis can be devastating. Recently, a man in Montana sued over wrong diagnosis where a doctor's negligence resulted with him being sent home with a broken neck. When somebody isn't diagnosed correctly, it's oftentimes because the right scans and tests were not conducted on them. This is the type of negligence an attorney can help you sue over, if you are brought to harm because of it.
