Sometimes they may believe you should and sometimes they won’t. You’ll have to discuss the merits of your claim with them to be sure whether or not you should proceed with any legal actions.

Lawyers have access to experts who can back up your claims, if they’re legitimate. These claims have to establish that the medical negligence that you’re alleging is the proximate cause of your loved one dying. This is sometimes harder than you might think. If your loved one had a serious medical condition, for instance, it may be very hard to establish that they would have lived if they’d been given the proper diagnosis and treatment. Some conditions are deadly no matter what doctors do to try to cure them.
Going to Court
There are cases where going to court will not be necessary. Sometimes, the doctor or the healthcare facility will offer a settlement for your wrongful death lawsuit. If this is the case, your attorney will let you know whether the offer is a fair one. If it is fair, it might be preferable to going to court. The costs of going to court will add to your legal bill.
