Under-treatment Under Threat for Malpractice
The media does a lot of reporting on the costs of healthcare and it's well-known that healthcare in the US comes at one of the highest prices in the world. Doctors and hospitals are always being pushed to reduce their costs but, according to an article on FierceHealthcare.com, the push to make healthcare cheaper puts patients at risk of being undertreated and doctors at risk of being sued for malpractice.
For Patients
One of the greatest risks that a patient faces is not having a serious condition diagnosed correctly. Patients are also, however, at risk of being given treatments that they do not want by doctors that are afraid of being sued. The article mentions that one solution to this is simple communication.Doctors that inform their patients honestly about their options for treatment, the side effects of those treatments and the actual likelihood that the treatment is going to succeed may find that many patients don't want the treatments anyway. This opens up the possibility that patients and doctors can work together to make intelligent decisions and that healthcare costs could be reduced because of it. The problems arise when patients are not given information or options and when they're simply not given enough testing to determine what really might be wrong with them.
Under-treatment and Failure to Diagnose
The article sites a study that showed that 50 of a group of nearly 2,000 doctors surveyed said that they order tests because of the fear of being hit with a malpractice suit. In reality, this is exactly the point of malpractice law; to make certain that doctors are accountable for doing their jobs. If they fail to order tests and miss diagnoses they should have caught, they can be sued for malpractice, in some cases. The simple solution of doctors doing their jobs, talking to patients and being straightforward about diagnoses and treatments, seems far preferable to everyone involved.If a doctor failed to diagnose a condition that you suffer with and they should have caught it, you do have the right to speak with malpractice lawyers about the matter.
Not every instance of a missed diagnosis ascends to the level of physician malpractice, but speaking with a lawyer is the best way to find out if yours does and if the doctor did breach their duty to you as a patient. A jury may award compensation in such cases.
