What is Medical Malpractice?

A medical malpractice suit generally alleges that a doctor was somehow negligent in their duties regarding the care of a patient. When the physician fails to perform up to standard, it can have devastating consequences. These medical malpractice claims generally deal with a physician who failed to demonstrate ordinary skill in the discharge of their duties.

Examples

Medical Malpractive lawyerMost medical malpractice claims seen in the media involve pretty incredible circumstances. These claims generally occur when someone underwent surgery and then found that instruments were left in their body, or, occasionally, a doctor has horribly botched a procedure. However, these types of medical mistakes are generally the exception, not the rule in malpractice cases.

One of the main features of medical malpractice claims is that whatever negligence the doctor exhibited caused the patient to come to further harm. Many times medical malpractice lawsuits occur when a physician simply fails to discharge their normal duties in a way that is competent, or at the very least in a non-negligent manner. For example, a doctor may accidentally prescribe medication that proves to be harmful or, at least, not helpful for a condition when they should have known better. A physician may also fail to order the proper treatment for an illness or injury that results in the patient coming to further harm.

Filing a Lawsuit
