Is it Defective?

A defective product is one that is more dangerous than is reasonable when it’s used as directed. There are some products that are deadly when used as intended. Guns, for example, are a product that everyone knows can cause fatal injuries. A product liability lawsuit would likely follow in short order, and for good reason.

Automobiles are an area where numerous product liability claims are filed. These usually involve safety deficiencies in the vehicles. If you take the firearm in the above example and replace it with a pellet gun, you’d see that the gun carries a warning. It will warn that the airgun is capable of causing injury and death and that eye protection needs to be warned when using the gun. This is an example of a manufacture taking their responsibility seriously. If the consumer injures themselves, they were warned. If that same airgun, however, was advertised as an appropriate toy for young children and as completely safe, then there would be grounds to pursue a product liability lawsuit. A great deal of these cases have to do with companies being dishonest or incomplete with their product information.
