Memorial Hermann Baptist Beaumont Hospital in Texas has been cleared of medical malpractice charges and will even receive attorney and legal fees. Justices in the Ninth District Court of Appeals of Texas found that the expert medical report inadequately concluded that the woman in question died because of the hospital’s negligence.
Laura Sebile died at the hospital in 2006 after her surviving husband and seven children say she underwent an unnecessary surgery and suffered negligence. The 70-year-old woman was morbidly obese and suffering from a number of health problems. The family claims that the hospital did not run necessary tests, punctured her heart during surgery, and failed to diagnose her with congestive heart failure. They sued the Texas hospital, two doctors, and an anesthesiologist saying that a chest x-ray revealed the congestive heart failure. They claimed that the anesthesiologist did not check her complicated medical history before putting her under.
Almost two weeks after the surgery Sebile died of complications from her operation. The massive bleeding during the surgery left Sebile unable to speak or eat afterward and soon she suffered from multiple-organ failure. In addition to neglect during her stay, her family says she suffered from undue pain in her last weeks.
The hospital said that all of Sebile’s medical woes and surgery complications were caused solely by the doctor who punctured her heart during surgery and that the initial surgery was not unnecessary.
