Dallas County May Settle Constable Car Accident Lawsuit

On Tuesday, Dallas County officials will vote on whether or not to settle a Texas personal injury lawsuit involving a car accident allegedly caused by a traffic deputy two years ago.
According to Dallas News, Precinct 5 deputy James Polk was exiting a parking lot and merging onto Beckley Avenue in Oak Cliff when he collided with a car with the right-of-way. The Dallas car accident, which took place in October 2009, injured the driver, 36-year-old Lidia Pacheco as well as her passenger, 14-year-old Dalia Pacheco. After the accident, Pacheco filed a Texas personal injury lawsuit against Dallas County seeking compensation for her injury and other damages.
This is only one of several recent legal issues faced by the Dallas County constables in recent months and years. While Polk was fired by Jaime Cortes in the weeks following the car accident and injury, the County still must decide whether to settle the injury lawsuit for around $17,000 or to go to court. The payment would cover $14,000 in damages related to Lidia Pacheco’s injuries and $3,000 related to Dalia Pacheco’s injuries. In addition, the county may need to pay a further undisclosed amount to Dalia Pacheco’s guardian ad litem in the case.
