Family Sues Texas Company For Not Maintaining Delivery Trucks

Two parents in Marshall, Texas, have filed a wrongful death lawsuit against a Tyler car dealership regarding the death of their son in a fatal truck accident two years ago. According to their complaint, the car dealership, for which their son was a temporary employee, did not properly maintain their delivery trucks and are responsible for their son’s death in a traffic accident.

In February of 2009, Andrew Frazier was driving a delivery truck owned by Tyler Motor Co. Inc. doing business as Hall Volvo GMC. During the trip, he hydroplaned while making a lane shift while driving the speed limit. His out-of-control truck slammed into another vehicle, and Fraizer died from his truck accident injuries.

After the fatal truck accident, Andrew’s parents, Michael and Amy Frazier, discovered that the tires on the delivery truck were bald and not fit to drive on. In addition, the family found that another delivery truck driver had been fired earlier in the year for complaining about the poor maintenance of the truck. In the wrongful death lawsuit, they state that the Texas car dealership failed to provide their son with a safe work environment and that they failed to provide their son with safe and properly working equipment.

According to the Southeast Texas Record, the Fraziers are seeking actual damages for loss of care, maintenance, support, services, advice, counsel and contributions, loss of society, emotional support and happiness, for mental depression and anguish, grief and sorrow, punitive and exemplary damages, interest and court costs. They have requested a jury trial in Harrison County.
