Forth Worth T Accident Victim Struggles To Settle Personal Injury Case

Almost a year ago, Dallas resident and kite-board instrucor David Horn was involved in a fiery five-vehicle wreck on Northeast Loop 820. The accident involved a Mobility Impaired Transportation Service (MITS) bus that was ticketed for failing to reduce speed to avoid an accident. While the “T” settled with many others involved in the Texas car accident, which killed one person and critically injured another, they did not settle with Horn. In addition, they won’t say why they will not settle.
In the ten months since the crash, Horn’s life has changed drastically. He can no longer kite-board – the sport that he loved and also the sport that made up his Dallas business. In addition, he still suffers from serious back injuries and doctors say he could suffer a secondary accident that could render him paralyzed. He was also financially hurt in the TX car accident. His car was damages, he lost $15,000 in kite board gear, and struggles to pay medical bills and for his $1,500 back brace. He could have back surgery – if he could afford it. Finally, his wife quit her job in order to better take care of her husband, but their relationship has also permanently changed.
Whatever the outcome, the Texas Transportation Authority will not have to pay more than $300,000 in settlement regarding the Dallas bus crash, as the organization benefits from a maximum liability cap for government owned entities.
