Galveston Man Sues Insurance Company After Truck Accident

A man who was seriously injured in a tractor-trailer accident in Galveston County has filed a lawsuit against his insurance company following the Texas big rig crash. In the lawsuit, the man states that his insurance company did not honor the part of the car insurance policy regarding underinsured motorists.

The truck accident took place on November 23, 2009, when Dennis Kroll was driving in the northbound lanes of Interstate 45. When traffic clogged, Kroll slowed with the flow, but a distracted or speeding 18-wheeler behind him could not stop in time and rear-ended Kroll’s vehicle. Kroll’s car then hit the vehicle in front of it. According to court documents, Kroll suffered a number of injuries to his back, neck, legs, and shoulders – and that the speed of the big rig broke his seatbelt during the collision. The big rig driver was underinsured.

After the truck accident, Kroll filed a car crash claim with Texas County Mutual Insurance Company. However, the insurance company refused to pay the full damages that Kroll believes he is entitled to. Altogether, Kroll says that the accident has cost him more than $200,000 in medical bills, lost wages, and other damages. He also says that he provided the insurance company with all of the necessary paperwork and documents related to his claim in a timely manner.
